This Offer is brought to you by L’Oreal India Private Limited (“L’Oreal”) and M/s FSN E-Commerce Ventures Pvt. Ltd, 104, Vasan Udyog Bhavan, Sun Mill Compound, SB Marg, Lower Parel (W), Mumbai – 400013 (hereinafter ‘Nykaa’).

  1. Offer is meant for Indian National residing in India only at the time of purchase as well as gratification. Minimum age to participate in this contest is Eighteen years and is applicable only to the Original purchaser (the name mentioned in the cash memo) purchased during the Offer period in India only from the Authorized Distributors and retailers of the L’Oreal in India (“Participant”). This Offer shall not be applicable to the employees, associates their dependents advertising and promotional agencies of this Offer and L’Oreal Auditors along with their associate and all dependents and shall also not be applicable in the State(s) where it is banned or stated to be illegal by any State Government .
  1. To participate in “Offer” consumer must have made purchase of Maybelline New York products (hereinafter ‘Products’) worth minimum Rs. 999/- (Rupees Nine hundred ninety nine Only) or more on 1st July 2018 at 12 am and ends on 2nd July 2018 at 6:00 am (Hereinafter ‘the Offer Period’) in the territory of India. Offer is valid only on purchase of any specified Products. The participant will be considered for the offer only if the end cart checkout price is greater than INR 999, including all offers offered otherwise.
  2. The participation in the Offer is purely voluntary and the same shall be construed as an acceptance of the terms and conditions stipulated herein. L’Oreal reserves the right to substitute the Rewards offered at any point of time. Such rewards will be of equal or greater value. L’Oreal shall not be responsible for any loss, injury or any other liability arising out of participation in the Offer. There are no cash alternatives for the Rewards and they cannot be exchanged for cash at any point nor transferred to someone else. L’Oreal will not be responsible for wrong contact details provided by the winners or for the failure of the communication links. The Winners are not permitted to participate in any subsequent publicity related to Offer except organized by L’Oreal.
  1. The contest begins on 1st July 2018 at 12 am and ends on 2nd July 2018 at 6:00 am. The participant qualifies for the random lucky winner draw if she spends greater than INR 999 on Nykaa on only Maybelline products. This value will be judged on the final checkout cart value, including all discounts and offers applicable on the cart. The winner will be picked by Nykaa on a random basis. This is subject to the terms and conditions mentioned in the points below. The reward includes a trip to New York for the winner and one more person of her choice.
  1. Terms and conditions regarding the REWARD:
  • Hotel Stay in New York City (3-4 Star Property) (Duration: 2 nights, 3 Days) for 2 persons – Participant and one additional person who must be above 18 years of age.
  • Flight Tickets (Economy Class) to and fro New York City from a major metro city (Delhi, Bangalore, Kolkata, Mumbai) for 2 persons – Participant and one additional person who must be above 18 years of age.
  • All transport to and fro the flight origin destination will be the sole responsibility of the participant.
  • All food, beverage and logistics costs within New York City and beyond are the sole responsibility of the participant.
  • Any extensions or preponements of the trip duration will be borne by the participant and will not be the responsibility of L’Oreal.
  1. The Participant who wins is responsible for their own Visa application as well as Passport renewal/ application. L’Oreal shall not be responsible for rejection of Visa. In case of Visa rejection, the offer is deemed withdrawn.
  1. Participants must not exchange offer with each other. If a participant commits any misconduct, fraud, cheating, and misappropriation or any act lacking in good faith, L'Oréal reserves the right to disqualify such participant.
  1. There is only one winner who will win the Offer.
  1. Timeline for revealing the winner is at the discretion of L’Oreal and Nykaa. The selection of winners lies solely with L’Oréal and Nykaa India Pvt Ltd. In case of disputes, L’Oréal India Pvt. Ltd.’s decision is final. The winner of the contest will be contacted individually as per the contact details provided by the participant.
  1. The final decision of the winners lies with L’Oreal India and Nykaa India Pvt. Ltd. Selection of the winner is final, conclusive and binding and no further appeal, enquiry and/or correspondence in this regard shall be entertained.
  1. L’Oréal will not be responsible for wrong contact details provided by the winners. Intimation that a participant is a Winner of the Contest hosted by L’Oréal will be sent by the brand via email or telephonically or by such mode of delivery as L’Oréal considers appropriate & at a time that is deemed by L’Oréal to be correct.
  1. If called upon, the winner will have to submit valid Identity and address Proof (PAN Card / Voter Card / Ration Card / Passport / Driving License, etc.) to L’Oreal.
  1. L’Oreal shall neither indemnify nor shall be held responsible for any insurance, injury (including fatal), loss (temporary or permanent), damage (direct or incidental), disruption, theft to person or whatsoever including but not limited to deficiency in service or quality. 
  1. Employees / Distributor / Dealer / Retailers of the participating companies are not eligible to avail this offer.
  1. Acceptance of the Rewards constitutes permission to L’Oreal to use the Winner's name, relevant details and/or photographs for purposes of publicity, advertising and/or trade without further compensation or notice. L’Oreal reserves the right to use the winners’ names and Offer entries for promotion and post-coverage of The Offer on L’Oreal’s social media platforms and other platforms.
  1. If you return a product purchased using a promotional offer your participation in the contest shall be deemed withdrawn. All decisions with respect to this offer, will be at the sole discretion of L’Oréal and the same will be final and binding on a non-offer able basis
  1. L’Oreal reserves the right to extend, cancel, discontinue, withdraw, change, alter or modify the terms and conditions of the Offer, at its sole discretion, without any notice at any time during the validity of the Offer. No correspondence will be shared in this regard. L’Oreal shall not be responsible for any loss or damage, if it has to discontinue or cancel this offer in compliance with any law, ruling, order, regulation, requirement or instruction of any Central/State Government, or for any other unavoidable reason beyond their control. Participants shall be informed of such discontinuance/cancellation as soon as possible.
  1. The Offer is subject to force majeure conditions. All warranties of any kind whatsoever, whether expressed or implied, are hereby expressly disclaimed by L’Oreal (India) including, but not limited to, meeting of the participants’ requirements or aspirations, timeliness, security, un-interruptedness, error-free, the results or reliability of the Offer, or the delivery, quality, quantity, merchantability, fitness for use or non-infringement in respect of any goods, services, emoluments, benefits or awards acquired or obtained through the Offer. 
  1. This offer is valid till the promo stock lasts or the end date, whichever is earlier. STOCKS without this offer are also available. Pictorial description of the products as shown in the point of sale materials and in the advertisement/banner are for reference purposes only and L’Oreal is under no obligation to provide the same class of goods as depicted herein and in other point of sale material.
  1. L’Oreal India Private Limited does not endorse the quality of any of the products or services being offered as vouchers under the Offer. Any complaints or queries pertaining to the Offer would have to be taken up directly with Nykaa by visiting website nykaa.com.
  1. L’Oreal respects the data privacy mandate and does not collect any personal data until required for the limited purposes of offer. The data collated under this offer, if any or willingly shared by customer shall be used in strict confidence by L’Oréal/Website and it will not be passed to any third party for any commercials reasons. The data collected under this offer shall be permanently deleted by L’Oreal after the expiry of the event.
  1. To the extent legally permitted, L’Oreal excludes all conditions, warranties, guarantees and similar, whether express or implied, as to the condition, suitability, quality, fitness or safety of any goods or services supplied by us (Warranties), other than those implied by statute which may not be legally excluded.  Any liability we may have to you under Warranties implied by statute which cannot be excluded is limited, where expressly permitted by statute, to supplying, or paying the cost of supplying, the goods or services again or repairing, or paying the costs of repairing, the goods, at our option.

Subscribers who have opted for DND (Do Not Disturb) facility with their respective service providers may not be able to receive sms/ emails/calls L’Oreal would not be liable or held responsible for any lack or lapse in any communication on account of failure or delay by any of the Internet, Telecom, SMS and E-mails service provider including spam email.

  1. L’Oreal would not be liable or held responsible for any lack or lapse in any communication on account of failure or delay by any of the Internet, Telecom, SMS and E-mails service provider. L’Oreal shall not be responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof. L’Oreal shall not be liable or held responsible for quality of service or any service discrepancy.
  1. This offer is subject to all taxes, duties, levies as applicable from time to time under existing laws and regulations of the country.

  1. Any dispute arising out of or in connection with this offer shall be subject to the exclusive jurisdiction of the courts or forums in Mumbai only. The existence of dispute, if any, shall not constitute a claim against L’Oréal.
  1. These terms and conditions shall prevail over any inconsistent terms, conditions, provisions or representations contained in any other promotional or advertising materials for the offer. The terms and conditions can be altered at any time, if needed by L’Oréal solely at their discretion.
